Personalisation: a rough guide

This guide aims to tell the story so far about the personalisation of adult social care services. It is intended to set out the current understanding of personalisation at a very early stage of implementation, exploring what personalisation is, where the idea came from and placing the transformation of adult social care in the wider public service reform agenda.

Key points

The report contains the following key messages and recommendations:

By identifying and transferring knowledge about good practice, SCIE has a special role to play in transforming adult social care services.
Person-centred planning and self-directed support will need to become mainstream
It will ultimately mean universal services such as transport, housing and education are accessible to all citizens.
The personalised system will need to be cost-effective and sustainable in the long term.
Approaches to early intervention and prevention need to develop further so that people are encouraged to stay healthy and independent.
The social care workforce will need to acquire new skills.

Personal Health Budgets

Lord Darzi announced in his Next Stage Review of the NHS that the Department will launch in 2009 a pilot of personal health budgets, as a way of giving patients greater control over the services they receive and the providers from which they receive services. The pilots will draw on the experience of other health systems and in social care.

Personal budgets sit in a spectrum of policies of personalisation, which also includes choice and care planning. As the Prime Minister said in the preface to the Next Stage Review:

‘We need a more personalised NHS, responsive to each of us as individuals … giving us real control and real choices over our care and our lives.’

The Personal Health Budgets project team is working to develop the outline for the pilot scheme and in doing so is working with a wide range of people. We want to hear from anyone who would like to share their experiences in this area and help shape the project. We are particularly interested to hear from organisations, users or carers who are already trying out personal health budgets.

In January 2009 the Department published Personal health budgets: first steps. This document sets out the principles of personal health budgets, reports on early lessons and invites expressions of interest in the pilot programme.

Draft deprivation of liberty safeguards standard forms made available in order to facilitate best practice, training and preparation in advance of April 2009, when the deprivation of liberty safeguards come into effect.

These forms are not to be used for making applications for deprivation of liberty authorisations, since they are not the final version that should be used for operationalising the safeguards procedures.

The forms can be adapted but, if used in unedited form, they help all those involved in the safeguards processes to fully meet the requirements of the deprivation of liberty safeguards legislation.

NHS Constitution Published

The first NHS Constitution for England, a landmark in the history of the NHS has been created through a collaborative approach of consultation, discussion and research with NHS Staff as well as patients, public and stakeholders.

The Constitution represents a commitment that all staff should have rewarding and worthwhile jobs, with the freedom and confidence to act in the interest of patients.

To do this, all NHS staff need to be:

trusted and actively listened to

treated with respect at work,

have the tools, training and support to deliver care,

and opportunities to develop and progress.

The NHS Constitution enables for the first time details as to what staff, patients and the public can expect from the NHS.

It sets out the purpose, principles and values of the NHS, as well as bringing together a number of rights, pledges and responsibilities for all staff and patients.

Valuing People Now - New vision for people with learning disabilities

People with learning disabilities will be supported in every aspect of their lives, from housing and health to employment, Secretary of State for Health, Alan Johnson announced today.

'Valuing People Now - A Three Year Strategy for People with Learning Disabilities' presents a new vision for improving services for people with learning disabilities across health, housing, employment and community care services. It follows a comprehensive consultation involving more than 10,000 people.

Improving training, commissioning of services and strengthening local structures to meet the needs of people with learning disabilities, are fundamental elements of the Strategy.

Key aims include:

* ensuring people with learning disabilities get the healthcare they need and the support they want to live healthy lives;

* supporting more people with learning disabilities, including those with more complex needs, into paid work;

* ensuring people with learning disabilities have the choice to have relationships, become parents and continue to be parents; and

* giving people with learning disabilities opportunities to study and enjoy leisure and social activities.

Progress will be reviewed annually. A new national Learning Disability Programme Board and Regional Boards will ensure the strategy works, share good practice and provide a forum for stakeholder groups to discuss progress and concerns.

Autism and Employment Study

Understanding autism and employment is important for people with autism, Asperger syndrome and other conditions on the autism spectrum, as well as for their families.

Researchers at Goldsmiths, University of London, want to find out about the emotional, physical and financial impacts on people with autism spectrum disorders and their families.

They would like to hear from people who are:

an adult with a diagnosed autism spectrum disorder
a parent of a person with a diagnosed autism spectrum disorder.

The questionnaire will take 20-30 minutes.

Mutual Caring Project: Supporting older families who are looking after each other

Lots of people with learning disabilities live at home with their older family carers, usually their mum or dad, brother, sister or grandparents. Although their carers still do lots to look after them, lots of people with learning disabilities do a lot to help look after their older carer too. When everyone is looking after each other, this is called ‘mutual caring’.

Lots of people don’t get the help they need when they are carers. Lots of workers don’t realise that mutual caring is happening in older families. Lots of people do not realise that people with learning disabilities can be carers too.

There are many things people can do to support older families where mutual caring is happening. This project aims to raise awareness about mutual caring and the different things that people can do to support older families.

Local authority support for adults with autism

As part of the National Autistic Society (NAS) I Exist campaign, all local authorities in England were asked if they have a system in place to record the number of adults with autism in their area and if, in line with Department of Health guidance, they have appointed a named individual or team with responsibility for autism.

With the support of thousands of campaigners who have contacted their local authority to raise these demands, the NAS have now received a response from over two thirds of local authorities.

A table has been produced this week and progress is indicated according to the following key:

green indicates progress in the area in question
amber indicates a recognition of the issues and a willingness to address these
red indicates no evidence of progress in the relevant areas
purple indicates that the NAS have not yet received a response from the local authority.

Commissioning specialist adult learning disability health services - Good practice guidance

Good practice guidance on the commissioning of specialist adult learning disability health services for adults.

Consideration has been given to assist in responding to shortcomings identified in these services in recent Healthcare Commission reports including those into abuse in Cornwall and Merton and Sutton.

Within the current environment of separating out purchaser and provider arms of PCTs services are currently debating who should employ specialist learning disability staff - another health provider, mental health trust, social services, social enterprise....

The report states that:

"Specialist learning disability health staff are most likely to be employed within the local NHS, with those not in in-patient settings, operating as part of, and being accountable within, a multi-disciplinary structure such as a community learning disability team (CLDT) that is led or jointly led by the local authority.

Employment within the NHS alongside other health professionals is important in order to maintain appropriate clinical governance, professional development, relationships and learning from colleagues working in other specialisms and to avoid recruitment and retention problems. However, day-to-day operation within a multi-agency framework is essential for the achievement of good person centred outcomes. Being recognised as part of the NHS is particularly important for staff working to promote access to mainstream primary care and acute hospitals in order to facilitate day to day working relationships with NHS colleagues."

Disability Equality Duty Reports published 1st December 2008

The Government has today highlighted progress towards achieving its ambition of equality for disabled people by 2025 with the publication of a series of reports from 11 Secretaries of State, the Office for Disability Issues’ (ODI) annual report and additional research about the Disability Equality Duty.

The reports by the 11 Secretaries of State are the first of their kind. They identify progress towards disability equality made by each department and where there are still issues to address. They also show how departments and public bodies will work strategically to introduce mechanisms for change. The ODI has produced an overview of the Secretary of State reports, highlighting key findings from each.

Evaluation of the Individual Budgets pilot programme: final report

The Individual Budgets pilot programme was a cross-government initiative led by the Department of Health working closely with the Department for Work and Pensions, and Communities and Local Government.

The pilot was conducted over two years 2006-2007 involving 13 local authorities.

The report was written by a combined team from The University of York Social Policy Research Unit and the Personal Social Services Research Units of Manchester University, LSE and University of Kent; and Kings College London. They were collectively called The Individual Budgets Evaluation Network (IBSEN).

New pack helps schools tackle bullying of people with learning disabilities

Over the last year UR Consultants, a social enterprise set up by United Response and staffed by people with learning disabilities in the Trafford area of Greater Manchester, has been working with local schools to tackle the bullying of people with learning disabilities.

The pack was developed as a result of training UR Consultants delivered in schools. This face to face training included presentations, class discussions, games and short films, as well as members of the team sharing their own personal experiences of being bullied. All of these elements are represented in the pack.

“Children who live in areas with heavy rainfall could be more likely to develop autism”

The Daily Telegraph has reported that children who live in areas with heavy rainfall could be more likely to develop autism.

The newspaper said that researchers believe that rain could be an “environmental trigger” for the condition, that makes “susceptible” children develop autism symptoms.It said the reason behind the association is unknown.

This study looked at annual rainfall in three US states and the number of children diagnosed with autism who lived in those areas in their first three years of life. It found there to be more children with autism living in wetter areas than in drier ones.

However it is important to be aware that this type of research can only demonstrate an association. It does not prove that rainfall has any connection with the development of autism and there are many other factors that may determine why some children in these areas develop autism.

The causes of autism remain unclear and are thought to include genetic, environmental and medical factors.

Many Parents choosing to keep Down's Syndrome babies

A research study conducted by the Downs Syndrome Association interviewing 1000 parents has found that more Down's syndrome babies are being born than before pre-natal screening became widespread.

The UK saw 749 Down's births in 2006, up from 717 in 1989 when tests came in.

A briefing note from the Foundation for People with Learning Disabilities and the Valuing People

Support Team

‘Healthcare for All’ (the report of the independent Michael Inquiry into access to health care for people with learning disabilities) was launched on 29 July 2008.

This Inquiry followed two previous reports highlighting the health inequalities and poor access to health care experienced by people with learning disabilities – the Disability Rights Commission Formal Investigation that reported in 2006 and Mencap’s ‘Death by Indifference’ report in 2007.

In launching the Inquiry’s report, Sir Jonathan Michael emphasised his concern that people with learning disabilities were effectively invisible to the mainstream NHS.

He urged each NHS body to act now to ensure that

‘reasonable adjustments’ are offered throughout the services they commission or provide.

Experiences of the Criminal Justices System of Prisoners with Learning Disabilities and Difficulties

Vulnerable people face abuse and discrimination throughout the Criminal Justice system

A failure of leadership and direction across the criminal justice system has resulted in vulnerable people facing personal, systemic and routine discrimination from the point of arrest through to release from prison, according to a groundbreaking, three year review published in November 2008 by the Prison Reform Trust.

Prisoners Voices finds that, at worst, the absence of police safeguards increases the likelihood of vulnerable people experiencing miscarriages of justice, that once in court their lack of understanding grows as their lives are taken over by opaque court procedures and legalistic terminology and in prison many are left to fend for themselves in a shadowy world of not quite knowing what is going on around them or what is expected of them.

Prisoners Voices is the concluding report of the Prison Reform Trust's No One Knows programme revealing the experiences of people with learning disabilities or difficulties in contact with the criminal justice system.

Previous reports, have estimated that 20-30 per cent of offenders have learning disabilities or difficulties that interfere with their ability to cope within the criminal justice system.

The report has been submitted to the independent Bradley review looking at the diversion of offenders with mental health problems and learning disabilities, which is expected to report to ministers in the New Year.

Although the report finds pockets of good practice it concludes that those providing leadership in the criminal justice system throughout the UK are failing in their legal duty to eliminate disability discrimination and promote equality.

NHS Next Stage Review Final Report : High Quality Care for All

Over the last 12 months Lord Darzi (Parliamentary Under-Secretary of State) has led the NHS Next Stage Review. As a result High Quality Care for All, the final report of the NHS Next Stage Review has now been published

High Quality Care for All is about enabling visions of high quality health care to be delivered and supporting improvements that have been developed and agreed locally.

The final report sets out wide-ranging proposals that place quality of care at the heart of everything the NHS does, empowering patients and staff to secure effective and personalised care.

It sets out a vision for a 21^st Century NHS that:

Helps people to stay healthy.

Gives patients more rights and control over their own health and care.

Gives patients even greater influence over the services they use.

Places quality at the heart of everything it does.

Improving Access to Psychological Therapies (IAPT) TOOLKIT

The Improving Access to Psychological Therapies (IAPT) programme has one principal aim - to help PCTs implement NICE Guidelines for people suffering from depression and anxiety disorders. The Government is committed to improving access to psychological therapies and announced additional funding to increase services over the next three years.

This Commissioning Toolkit is designed to help PCTs improve or establish stepped care psychological therapies following NICE guidelines.

The toolkit is structured around the commissioning cycle and is specifically linked to the World Class Commissioning competencies.

It brings together a wide range of existing tools and guides and includes positive practice examples throughout.

The latest newsletter is about some of the important things families of people with a learning disability need to know to have more choice and control in their lives.

The focus is on families and ‘self directed support’, or what has been more

recently called Personalisation.

The aim of the newsletter is to try and give families some information about

personalisation and the different ways that it can help people have more

choice and control in their lives. This is done through stories from

families who are already ‘doing’ self directed support.

Local government leaders say that unless councils talk to residents in a language they understand, the work they do becomes inaccessible. This reduces the chances of people getting involved in their local issues.

What is the disability equality duty?

Disability Equality Duty

The Disability Equality Duty came into force on 4 December 2006.

This legal duty requires all public bodies to actively look at ways of ensuring that disabled people are treated equally. All of those covered by the specific duties must also have produced a Disability Equality Scheme, which they must now implement.

The DED, also referred to as the general duty, sets out what public authorities must have due regard to in order to promote equality of opportunity. Most public authorities are also covered by the specific duties, which set out a framework to assist authorities in meeting their general duty. All public authorities covered by the specific duties must: publish a Disability Equality Scheme (including within it an Action Plan) involve disabled people in producing the Scheme and Action Plan demonstrate they have taken actions in the Scheme and achieved appropriate outcomes report on progress review and revise the Scheme

The Commission has an overview guidance on the duty to give a brief introduction into what it is and what it means for public bodies and disabled people. This document contains information on key dates for the duty, and details of the Disability Equality Scheme and the Action Plan

New Ways of Working for Applied Psychologists NWWAP

The New Ways of Working for Applied Psychologists sub-group was established in July 2005 and has met every two months up to the launch conference in Leicester in July 2007 when the group had completed its work. The group is jointly chaired by Roslyn Hope (NIMHE, NWP) and Professor Tony Lavender (BPS) and included representatives of carers and users, from the divisions of applied psychology and other professions, including psychiatry, nursing and the allied health professions. Two stakeholder conferences were held in Wolverhampton and Edinburgh. The group has addressed the following seven objectives:

to review the pre-qualification roles of psychology graduates, including Primary Care Mental Health Workers (PCMHWs), and recommend how they could be developed to contribute to the sustainable delivery of psychological services;

to review the current training models for applied psychologists, develop and assess alternative models and make recommendations for the future;

to map the current workforce, identify emerging good practice in new ways of working and develop role descriptions for all levels across the career framework and produce guidance for National Assessors;

to identify the best models for organising psychological services within Trusts and review the leadership development needs of applied psychologists;

to identify the best ways that applied psychologists can contribute to the development and work of multidisciplinary teams;

to identify the way that applied psychologists can improve user access to psychological therapies; and

to clarify the role, training needs and registration requirements of applied psychologists in implementing the new mental health legislation.

Best Interests Guidance - British Psycholological Society

Guidance on determining the best interests of
adults who lack the capacity to make a decision
(or decisions) for themselves (Jan 2008)

This guidance has been written in order to give additional information and support to people who may
have to participate in making decisions on behalf of adults who lack the capacity to do so for themselves.
This includes staff working in health or social care (such as doctors, nurses, dentists, psychologists,
therapists, social workers, residential and care home managers, care staff, support workers) and carers,
families and advocates.

The legal framework for making best interests decisions is defined in the Mental Capacity Act 2005, and
further policy guidance is to be found in the Code of Practice to the Mental Capacity Act. This guidance
aims to add further to the Code of Practice by looking in more detail at the types of factors that might
need to be considered in making a best interests decision, and in considering the process of best interests
decision-making.

About the conference

The Estia Centre, Salomons (Canterbury Christ Church University) and Pavilion are hosting a one-day national conference on Thursday 31 January 2008 in Camden, London to explore the mental health needs of people with learning difficulties.

This conference is being convened by Steve Hardy of the Estia Centre and Professor Hilary Brown of Canterbury Christ Church University and the Sussex Mental Health Trust to explore the mental health needs of people with learning disabilities and how these can best be met by a web of mainstream and specialist mental health services. Despite a commitment to accessing mainstream psychological therapies being at the heart of recent policy, confidence levels are low and practical barriers remain. This conference addresses these issues at the level of service development and in relation to clinical and therapeutic skills.

The public consultation concerning the Section 60 Order (S60) - the draft secondary legislation, which would take practitioner psychologists into regulation by the Health Professions Council (HPC) - has just been published by the Department of Health, following several delays.

The public consultation is open for only 12 weeks. Our process to respond to the S60 will be the same as we are employing to respond to the two consultations from the HPC:

the office will prepare a draft response by 25 January 2008
a briefing meeting will be held for Representative Council
the draft response will be posted on the members' area of the website and therefore available for subsystems and individual members to make their response
the final deadline for those responses will be 22 February 2008
the office will then revise the draft response, this will be available for a final review by the membership, and the Trustees will sign-off the document before submission.

A Fresh Challenge: New guidance and policy to support people with learning
disabilities who present behavioural challenges

Wednesday 23 January 2008, London 

In 2007, a joint working group of the Royal College of Psychiatrists and the
British Psychological Society, in consultation with the Royal College of Speech
and Language Therapists produced a new Council Report, 'Challenging
behaviour: a unified approach'.  The report provides clinical and service
guidelines for supporting people with learning disabilities who present
behavioural challenges and are at risk of receiving abusive or restrictive
practices. The working group was greatly assisted by Professor Jim Mansell who
at the same time has been revising his original report from 1993 on services for
people with learning disabilities and challenging behaviour with mental health
needs.

This conference aims to explore how these two complementary publications can
direct the future development of services for people who present challenges and
how to enable people to think about ways in which they can plan and implement
changes by engaging service users and carers in a collaborative approach to
service provision and development.

Challenging Behaviour: A Unified Approach

Clinical and service guidelines for supporting people with learning disabilities who are at risk of receiving abusive or restrictive practices

This report is the result of a joint working group of the learning disability faculties of the British Psychological Society and the Royal College of Psychiatrists, in consultation with the Royal College of Speech and Language Therapists. The main focus is on adults who are vulnerable to restrictive interventions and abuse as a consequence of their limited capacity to make choices for themselves about where they live or work, and how they are supported.

This report concerns standards of clinical practice in supporting people with learning disabilities who present behavioural challenges. It unites the clinical theory and practice of health professions that have specific models for the assessment and management of challenging behaviour. The fundamental unifying principle is to improve the quality of life for people whose behaviour challenges others.

The report focuses primarily on adults with moderate to severe learning disabilities, although the broad principles outlined are applicable to children and adults of all degrees of intellectual disability. People with learning disabilities who present behavioural challenges are often marginalised, stigmatised, disempowered and excluded from mainstream society.

This report has been produced with the following aims:

To revise and develop the interpretation of the term challenging behaviour.
To bring together relevant, available, evidence-based practice with a consensus of clinical opinion and experience.
To provide a unified framework for good practice in multidisciplinary clinical and social interventions.
To encourage the development of creative, flexible and effective responses to individuals who present behavioural challenges.
To provide guidance for service developers and commissioners.
To inform and empower service users and their carers.
To provide a set of standards of good practice against which service provision can be benchmarked and audited.
To promote the development of comprehensive and effective local services and to reduce the number of individuals who are failed by the current service provision.
To provide a framework for training of health and social care professionals and paid support staff and carers.
To guide future research and development.

The unifying principle is to improve the quality of life of people whose behaviour challenges services. It hopes to complement other publications and guidance in this area and overall to further a reinvigorated and unified approach to supporting people whose behaviour is experienced as challenging. This requires a multidisciplinary and multi-agency approach, and therefore the report has been produced with the intention that it will be relevant and useful to a wide range of health and social care professionals, family and paid carers, service providers and commissioners.

It is intended to provoke action as much as to inform, and to encourage local and national debate, analysis, review and response.

Psychological Interventions for Severely Challenging Behaviours Shown by People With Learning Disabilities

One of the most frustrating things about working with people with challenging behaviours is the gulf that often exists between academic research and traditional professional practices on the one hand, and the needs of people with challenging behaviours on the other. The publication of the clinical practice guidelines by the British Psychological Society goes a long way towards setting a standard for professional practice. In doing so, the authors have successfully unified research and practice into a single strand that, in our current state of knowledge, is likely to improve the treatment of perhaps the most marginalised group of people with learning disabilities.

In essence, the guidelines propose that positive behavioural support (PBS) is the benchmark for intervention in the field of challenging behaviours. There are 52 guidelines in total, each of which is based on research evidence and described as either 'essential' or 'good' practice. Three essential core guidelines set out the value base of PBS. They focus on recognising the person's unique strengths and needs and unique social context, adopting a coherent process of assessment-driven intervention and considering the person and the environment as well as the behaviour. Assessment is therefore idiographic rather than diagnostic; intervention is systemic as much as intra-psychic. Seeking consent before assessment, maintaining confidentiality, eliciting feedback, assessing risk and preventing abuse are all essential practice.

Lots of people don’t get the help they need when they are carers. Lots of workers don’t realise that mutual caring is happening in older families. Lots of people do not realise that people with learning disabilities can be carers too.

There are many things people can do to support older families where mutual caring is happening. This project aims to raise awareness about mutual caring and the different things that people can do to support older families.
